What does a Houston healthcare lawyer do?

Healthcare lawyers apply the rules unique to medicine: practice ownership, referral and pay arrangements, claim billing, privacy, and board or agency investigations. Dike Law Group handles formation, licensing, contracts, compliance, deals, and defense for Houston clients, and many start with one matter and keep the firm on afterward. HIPAA governs the privacy and security of patient information, and Texas Health and Safety Code Chapter 181 adds privacy duties of its own. The Stark Law bars certain physician referrals to entities with a financial relationship, regardless of intent. The Anti-Kickback Statute makes knowingly and willfully offering or accepting payment for federal program referrals a crime. The HIPAA compliance checklist shows where gaps often hide. 

Review compensation, call obligations, termination terms, and any non-compete. For physician agreements signed or renewed on or after September 1, 2025, Texas Senate Bill 1318 limits a non-compete to one year and a five-mile radius from the primary workplace. Terms are easier to change before signing than after. The contract review checklist goes further. 

A healthcare employment lawyer negotiates offer letters, employment agreements, restrictive covenants, termination language, and contractor arrangements. Texas generally treats employment as at will unless an agreement says otherwise, so the written contract controls. The Texas Medical Board handles complaints against physicians statewide, so a Houston physician follows the same process as anyone else in Texas. A complaint typically brings written notice and a request for a response, and discipline falls under Texas Occupations Code Chapter 164. Speak with counsel before responding. In most cases, Texas law keeps medical practice ownership with physicians because of the corporate practice of medicine (CPOM) doctrine. Outside investors usually enter through a management services organization (MSO) that supplies business services to a physician-owned practice.
